Frequently Asked Questions

How long does a standard residential conveyancing matter take?
Sub-sale transactions typically complete within three to four months from SPA execution, depending on the land office's processing time for the consent or restriction-in-interest application, and how promptly the bank releases the loan disbursement. Direct developer purchases may take longer if the title has not yet been issued. We provide a written timeline at the start of each matter so you know which stage is the current bottleneck.
What is included in the residential conveyancing fee?
The fee of RM 1,450 covers title search at the relevant land office, review of the sale and purchase agreement, loan documentation review, stamp duty computation, preparation of the memorandum of transfer (Form 14A), and liaison with the bank's solicitors. Disbursements — meaning the actual stamp duty, registration fees, and search fees — are billed at cost separately and will be itemised in your engagement letter.
My property has a restriction in interest. Can you still assist?
Yes. Properties described as "Tanah Rizab Melayu" or subject to other restrictions in interest require consent-to-transfer applications to the relevant state authority before transfer can proceed. We handle these applications regularly and will advise you on the expected processing time for the relevant state at the outset of your matter.
What is the difference between a caveat and a court injunction?
A private caveat, lodged under the National Land Code, is a notice on the land title that prevents any dealings — transfers, charges, or leases — from being registered while it remains. It does not prevent the registered owner from occupying the property. A court injunction is a court order that can restrain conduct more broadly, including occupation. The appropriate step depends on what you are trying to protect and within what timeframe. We will advise on this during an initial consultation.
Do you handle commercial lease renewals and rent disputes?
Yes. Our commercial leasing work includes lease renewals, rent review negotiations, dispute resolution under the lease terms, and advising on early termination or yielding-up obligations. Where a tenancy dispute escalates to formal proceedings, we can represent either landlords or tenants in civil court. The scope and fee for each matter are agreed in writing before we begin.
What information should I prepare before the first consultation?
For a purchase or sale matter, it helps to have the property address, the title number if known, the agreed sale price, and any correspondence exchanged with the other party or the developer. For a dispute matter, please gather all relevant correspondence, any notices or demands received, and the title particulars if available. A summary of the timeline of events is also helpful. If you do not have all of this, we can still begin the consultation — we will identify what additional documents are needed.
