Our Methodology

How we approach every property matter

The methodology at Tanah Partners is documentary. We begin by reading the title — not the summary, but the actual certificate of title and the registered instruments — and advising from what we find there rather than from assumptions about what the situation should be.

Each matter is structured in stages, with a defined output at the end of each stage and a check before we move to the next. This means that issues are identified in sequence rather than discovered at completion. When a question arises, it is answered in writing so there is a record of what was decided and why.

Service 01

Residential Conveyancing (Sub-Sale & Direct Developer)

End-to-end conveyancing support for residential purchasers and vendors across Peninsular Malaysia, covering sub-sale transactions and direct-from-developer purchases. The engagement includes title search, SPA review, loan documentation, stamp duty, MOT, liaison with the bank's solicitors, and consent-to-transfer applications where required.

MOT prepared. Consent application filed if the title carries a restriction in interest.

Stamp duty, registration & completion

Stamp duty adjudicated and paid. MOT registered at land office. Written completion confirmation issued.

Service 02

Commercial Property & Leasing Transactions

Drafting and advisory on commercial leases, tenancy agreements for retail and office premises, and commercial property acquisitions. Engagement covers landlord-tenant negotiation, rent review mechanisms, renewal options, yielding-up clauses, and fitting-out arrangements. A named partner serves as the single point of contact throughout.

Typical Engagement Duration

Service 03

Title Disputes, Caveats & Land Office Proceedings

Representation in contested property matters including caveat applications and removals, boundary and encroachment disputes, strata-related disputes under the Strata Management Act 2013, and proceedings before the Land Administrator and the High Court. Matters are handled with a preference for negotiated resolution where the facts permit.

Our Dispute Approach

We begin every dispute matter with a review of the chain of title and supporting documents. The client receives a written merits assessment — including likely duration and estimated fee exposure — before any decision is made on how to proceed. Where a negotiated resolution is achievable, we pursue it before recommending contested proceedings.

Technical standards across all our services

Client Fund Security

All client monies are held in a separate solicitor's account in accordance with the Solicitors' Accounts Rules. Disbursements are released only upon your authorisation.

Deadline Management

We track statutory deadlines — stamp duty payment periods, caveat expiry, and consent application time limits — and issue reminders well in advance of critical dates.

Solicitor-Client Privilege

All communications and documents you share with us are protected by solicitor-client privilege. We do not share your information with parties outside the matter without your written consent.

Document Retention

Completed matter files are retained for at least seven years. Clients may request copies of their matter documents at any time during or after the engagement.

Professional Indemnity

All partners and solicitors at Tanah Partners are covered by professional indemnity insurance as required by the Bar Council Malaysia.

Response Time Standard

Client enquiries are responded to within one working day. Status updates are issued without requiring a follow-up call from the client.
